By using Cusmaa (cusmaa.com), you agree to comply with these Terms of Service. Please read them carefully before placing or accepting any order.
1. Acceptance of Terms
  • By using the Cusmaa platform (cusmaa.com), you agree to be bound by these Terms of Service.
  • If you do not agree, please discontinue use of our platform immediately.
2. About Cusmaa
  • Cusmaa is a B2B2C marketplace platform connecting custom clothing vendors (tailors, boutiques, designers) with customers in Malaysia.
  • Cusmaa acts as a neutral intermediary and escrow agent — we are not directly responsible for the quality of products produced by vendors.
3. User Accounts
  • You must be 18 years of age or older to register an account.
  • Information provided during registration must be accurate and kept up to date.
  • You are responsible for maintaining the confidentiality of your account password.
  • Cusmaa reserves the right to terminate accounts that violate these terms.
4. Order Process
  • Submit Brief: Customer submits specifications and design to vendor.
  • Mockup: Vendor prepares a mockup within 1–5 working days (maximum set by Cusmaa).
  • Full Payment: Customer pays 100% upfront into Cusmaa escrow after approving the mockup.
  • Production: Vendor begins production — estimated timeline displayed on vendor profile.
  • Quality Check: Vendor performs quality check before dispatch.
  • Delivery: Vendor ships the product to the customer.
  • Completion: Customer confirms receipt; Cusmaa releases payment to vendor.
5. Escrow & Payment System
  • All payments are made 100% upfront into Cusmaa's escrow system to protect both parties.
  • Funds are held by Cusmaa until the order is completed and confirmed by the customer.
  • Payment is released to vendors after successful order completion.
  • Cusmaa charges a platform commission as stated in the vendor agreement.
  • All payments are in Malaysian Ringgit (MYR), processed via ToyyibPay.
6. Cancellation & Refund Policy
  • Before mockup approved: Full cancellation, 100% refund.
  • After payment made: Non-refundable if production has commenced.
  • Defective or non-conforming product: Vendor must redo or issue a refund.
  • All disputes will be resolved through Cusmaa's mediation process.
7. Vendor Responsibilities
  • Provide services in accordance with agreed specifications.
  • Update order status accurately and in a timely manner.
  • Must not communicate with customers outside the Cusmaa platform.
  • Adhere to quality standards set by Cusmaa.
  • Be responsible for product quality and on-time delivery.
8. Customer Responsibilities
  • Provide clear and complete specifications and design files.
  • Approve or reject mockups within a reasonable timeframe.
  • Make payments according to the scheduled process.
  • Provide honest feedback through the rating system.
9. Intellectual Property
  • Designs uploaded by customers remain the property of the customer.
  • Vendors are not permitted to use customer designs for any other purpose without written consent.
10. Limitation of Liability
  • Cusmaa is not responsible for any indirect, consequential, or incidental loss arising from use of our platform.
  • Maximum liability of Cusmaa is limited to the total transaction value of the relevant order.
11. Governing Law
  • These Terms of Service are governed by the laws of Malaysia.
  • Any disputes shall be resolved in courts of competent jurisdiction in Kuala Lumpur, Malaysia.
